1. Who We Are
"Plushly", "we", "our", and "us" refer to Plushly and its operators.

2. What These Terms Cover
These Terms govern your access to and use of:
- The website at plushly.ai and any subdomains
- The Plushly desktop application for macOS and Windows
- The Plushly mobile application for iOS (available on the Apple App Store)
- The AI-powered resume builder
- Job application automation features
- All associated content, features, and functionality
(together, the "Services")
3. Key Definitions
- Content: any text, graphics, data, or other materials in the Services, including AI-generated output
- User Content: materials you upload or provide (e.g., resumes, job preferences, profile information, application answers)
- Paid Services: fee-based features including subscriptions (Pro, Max)
- AI Output: text, suggestions, or content generated by our AI systems based on your inputs
4. Acceptance of Terms
By downloading, installing, or using Plushly, including by subscribing to a plan, you agree to these Terms and to our Privacy Policy. If you do not agree with either, please do not use our Services. Continued use constitutes acceptance.
5. Eligibility & Accounts
You must be at least 18 years old or the age of majority in your jurisdiction to use Plushly. If you are under this age, you may not use our Services.
You must provide accurate information, keep it current, and safeguard your login credentials. You are responsible for all activity under your account, including plan usage, and must notify us immediately of any unauthorized use.
Accounts are personal and non-transferable. You may not share, sell, lend, or otherwise make your account available to any other person.
6. Description of Service
Plushly is a desktop and mobile application that assists users in automating job applications on supported platforms. The service uses automation technology and AI to help streamline the job application process based on user-provided information and preferences.
Key features include:
- Automated job searching based on your preferences
- AI-powered form filling for job applications
- AI resume generation and optimization
- Review-and-approve mode for user-selected applications
- Hands-free autopilot mode for paid plans
- Application tracking and statistics
Service features are subject to your subscription tier, operational safeguards, and fair use limits.
7. User Responsibilities & Acceptable Use
You are responsible for ensuring that all information you provide through Plushly is accurate, truthful, and up-to-date. You agree to:
- Provide truthful information about your qualifications, experience, and work authorization
- Review AI-generated content before submission to ensure accuracy
- Use our service only for lawful purposes
- Comply with the terms of service of any third-party platforms you interact with (including LinkedIn)
- Monitor and manage your own plan settings and application activity
You must not:
- Misrepresent your identity, qualifications, work authorization, or any legally required disclosures
- Use the Services to apply for jobs you are not legally eligible for
- Introduce malware or interfere with the Services
- Reverse engineer, decompile, or attempt to extract source code from the application
- Scrape, harvest, or collect data from the Services at scale
- Share, resell, or sublicense your account access
- Use the Services to harass employers or submit spam applications
- Circumvent any rate limits, usage caps, or security measures
- Exploit bugs, errors, or system vulnerabilities to gain services not paid for
- Create multiple accounts to obtain promotions or circumvent usage limits
- Use automated means (bots, scripts, or similar) to interact with the Services except through our intended application interface
8. Third-Party Platforms & Compliance
Plushly interacts with third-party job platforms, primarily LinkedIn. You acknowledge and agree that:
- You are responsible for maintaining your own LinkedIn account in good standing
- Third-party platforms may have their own terms regarding automation, and compliance is your responsibility
- Third-party platforms may restrict, suspend, or ban accounts that use automation tools
- We have no control over third-party platform decisions and cannot guarantee your account will not be affected
- We are not liable for any actions taken by third-party platforms, including account restrictions or bans
You use Plushly's automation features at your own risk and discretion. We recommend using manual review mode and applying at reasonable rates.
9. Fair Use & Operational Safeguards
To protect platform health and maintain service quality for all users, we may:
- Impose daily, weekly, or other periodic application or usage limits
- Queue, batch, space, or delay application submissions
- Temporarily restrict access to specific features or job platforms
- Implement rate limiting at our discretion
- Prioritize processing for certain subscription tiers
These safeguards are operational measures, not changes to your plan. No refunds or compensation are owed as a result of routine operational adjustments.
10. Subscription Plans & Tiers
Plushly offers the following tiers:
- Free: matched job deck, one-tap assisted apply on supported jobs, basic profile-based form filling, and application tracking.
- Pro ($19/month): 3 concurrent agents, hands-free autopilot, larger job-deck refills, AI resume tailoring, AI cover letters, and AI-generated application answers.
- Max: currently dormant and aligned to Pro for existing or legacy accounts.
Students with a valid .edu email may be eligible for a promotional discount on paid plans. Student discounts are subject to verification and may be modified or discontinued at any time.
Prices are displayed at checkout and may change. We will notify existing subscribers at least 14 days before any price increase takes effect on their account. Subscriptions renew automatically at the then-current rate unless cancelled at least 24 hours before the end of your billing period.
Plushly reserves the right to modify the features, operational limits, and pricing of any plan at any time. Changes to plan structure apply at the start of your next billing period unless otherwise stated.
11. Billing & Payment
Payments are processed securely through Stripe (web and desktop) or Apple via in-app purchase (iOS). By providing payment information or completing a purchase, you authorize us and the applicable payment processor to charge the applicable fees.
- Subscriptions: Recurring charges are billed at the start of each billing period (weekly or monthly, depending on your plan). You authorize automatic renewal until you cancel
- Failed payments: If a payment fails, we may suspend access to paid features until payment is successfully collected. We are not responsible for any fees your bank, payment provider, or Apple may charge for failed or reversed transactions
- Taxes: Prices may not include applicable taxes, which are your responsibility
- iOS purchases: Subscriptions purchased through the iOS application are processed by Apple and are subject to Apple's terms and conditions, including Apple's refund policies. To manage or cancel iOS subscriptions, use your device's Settings > Apple ID > Subscriptions
On web and desktop, you may manage your subscription and payment methods through the Stripe Customer Portal accessible from your account settings. On iOS, subscriptions are managed through your Apple ID settings. Cancellations take effect at the end of your current billing period. You retain access to paid features until then.
12. Refund Policy
General policy: All purchases, including subscriptions, are final and non-refundable. We encourage you to use the free tier to evaluate the Services before making a purchase.
Limited exceptions: Refunds may be considered at our sole and absolute discretion if all of the following conditions are met:
- You report a reproducible, verified technical issue caused by our platform that materially prevented access to or proper use of the Services
- You contact our support team within 7 days of the issue and provide reasonable evidence (screenshots, error messages, steps to reproduce)
- You allow us reasonable opportunity to diagnose and resolve the issue before requesting a refund
Refunds are not available for: dissatisfaction with results, failure to receive interviews or job offers, third-party platform issues, changes to your personal circumstances, or any reason outside our direct control.
Subscription renewals: Refunds for renewed subscriptions are generally not available. It is your responsibility to cancel at least 24 hours before your renewal date to avoid charges for the next billing period.
Chargebacks: If you initiate a chargeback or payment dispute instead of contacting us, we reserve the right to immediately suspend your account and contest the dispute. Accounts with unresolved chargebacks may be permanently terminated.
iOS purchases: Refund requests for purchases made through the Apple App Store must be directed to Apple in accordance with Apple's refund policies. We do not have the ability to process refunds for Apple in-app purchases.
Consumer rights: Nothing in this section is intended to override mandatory consumer protection rights under applicable law. If you are a UK/EU consumer, by purchasing digital services you acknowledge that you are requesting immediate performance and consent to losing your statutory right of withdrawal once the service has been delivered or consumed.
13. License to User Content
You grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, and display User Content solely to operate, secure, and improve the Services. You retain all other rights to your content.
If you submit feedback or suggestions, you grant us a perpetual, irrevocable license to use them without restriction or compensation.
14. AI Output & Disclaimers
AI-generated content (including resume text, cover letters, and application answers) may be inaccurate, incomplete, or unsuitable for your specific situation. AI Output is provided "as is" for assistance purposes and is not professional, legal, or career advice.
You must:
- Review and verify all AI-generated content before use or submission
- Ensure accuracy and suitability for each specific application
- Take full responsibility for any content you choose to submit to employers
Employers and platforms may use AI/bot-detection systems. We do not guarantee any particular outcome.
15. Intellectual Property
All Content (excluding User Content), including but not limited to the software, application code, design, branding, documentation, and APIs, is owned by us or our licensors and protected by intellectual property laws. No rights are granted except as expressly set out in these Terms.
You may not copy, modify, distribute, sell, lease, or create derivative works without our prior written consent.
16. Not an Employment Agency
Plushly is software tooling, not an "employment agency" or "employment business" under any applicable law. We do not:
- Introduce or supply workers to employers
- Negotiate employment terms on your behalf
- Guarantee interviews, job offers, or employment outcomes
- Make any representations about response rates or hiring timelines
17. Warranties & "As Is" Provision
To the maximum extent permitted by law, the Services, including AI features and all Content, are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that:
- The Services will be uninterrupted, error-free, or secure
- AI Output will be accurate, appropriate, or suitable
- Third-party platforms will accept automated applications
- Your use of the Services will result in any particular outcome
18. Limitation of Liability
Exclusions: To the maximum extent permitted by law, we are not liable for:
- Indirect, incidental, special, consequential, exemplary, or punitive damages
- Loss of profits, revenue, goodwill, data, or business opportunities
- Errors in AI Output or job matches
- Actions taken by third-party platforms (including account restrictions or bans)
- Failure to receive interviews, offers, or employment
- Any misrepresentations you make to employers
Cap: Our total aggregate liability for all claims arising out of or relating to these Terms or the Services is limited to the greater of $100 USD or the fees you actually paid for Paid Services in the 6 months immediately preceding the event giving rise to the claim.
Non-excludable liabilities: Nothing in these Terms limits liability that cannot by law be limited (e.g., liability for fraud or gross negligence where applicable).
19. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Services
- Your User Content or any AI Output you choose to submit
- Your breach of these Terms or applicable law
- Any misrepresentations or false information in your applications
- Your violation of third-party platform terms
- Your violation of any third party's rights
- Chargebacks, payment disputes, or fraudulent payment activity associated with your account
20. Dispute Resolution (U.S. Users)
Informal resolution first: Before filing any formal dispute, you agree to contact us at support@plushly.ai and attempt to resolve the matter informally for at least 30 days.
Arbitration: If you are a U.S. resident, any dispute arising out of or relating to these Terms or your use of the Services that is not resolved informally shall be resolved through binding arbitration on an individual basis, rather than in court. Arbitration shall be conducted under the rules of the American Arbitration Association.
Class action waiver: You and Plushly agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Exceptions: Either party may bring claims in small claims court if eligible. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.
21. Security & Beta Features
We implement reasonable technical and organizational measures to protect the Services, but we cannot guarantee absolute security. You are responsible for maintaining the security of your account credentials.
From time to time, we may provide beta or experimental features on an "as is" basis. These features may change or be withdrawn at any time without notice.
22. Force Majeure
Neither party is liable for delay or failure caused by events beyond reasonable control, including but not limited to: outages, cyberattacks, labor disputes, government action, pandemic, third-party platform changes, AI provider disruptions, or natural disasters.
23. Termination
By you: You may cancel your subscription at any time through the Stripe Customer Portal (web and desktop), your Apple ID subscription settings (iOS), or by contacting us. You may delete your account at any time through the application settings. Cancellation takes effect at the end of your current billing period.
By us: We may suspend or terminate your access immediately and without prior notice for breach of these Terms, abuse, fraud, non-payment, chargeback activity, or any other reason at our sole discretion. We may also terminate accounts that have been inactive for an extended period.
Effect of termination: Upon termination (however caused):
- Your right to use the Services immediately ceases
- We may delete your account data in accordance with our Privacy Policy
- Any outstanding payment obligations survive termination
Provisions that by their nature should survive termination will remain in effect, including sections on liability, indemnification, intellectual property, and dispute resolution.
24. Changes to Services
Plushly reserves the right to modify, update, suspend, or discontinue any part of the Services, including features, pricing, and plan structures, at any time, with or without notice.
If we materially reduce core functionality of a paid plan, we will make reasonable efforts to provide advance notice. You may cancel your subscription before the change takes effect, but no refund of prepaid fees is owed unless required by applicable law.
25. Changes to Terms
We may modify these Terms from time to time. Material changes will be announced via email or through the application at least 14 days before they take effect (or earlier if required by law or for security reasons). Continued use after the effective date constitutes acceptance. If you do not agree with revised Terms, you must stop using the Services.
26. Communications
We send service-related and transactional emails without opt-in consent (e.g., account verification, subscription confirmations, important service updates).
Marketing emails require your opt-in consent. You can unsubscribe at any time via the link in any email or through your account settings.
27. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
Subject to the arbitration provisions above, any disputes shall be resolved in the courts located in Delaware, and you consent to personal jurisdiction in such courts.
28. Assignment
We may assign or transfer these Terms (in whole or part) to any affiliate or successor, including in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations without our prior written consent.
29. Entire Agreement & Severability
These Terms and our Privacy Policy constitute the entire agreement between you and Plushly. If any provision is found unenforceable, the remaining provisions remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent. Our failure to enforce any right is not a waiver of that right.
